
Togo: Moov Africa is slapped on the fingers for failure to meet its service availability obligations

In May 2021, the telecommunications regulator sanctioned Moov Africa Togo for non-compliance with its service availability obligation. More than twelve months later, the situation is still not resolved.
The Regulatory Authority for Electronic Communications and Posts (ARCEP) announced on Tuesday, June 14, that it had given notice to Moov Africa Togo in accordance with the regulations in force. The regulator accuses the mobile telephone operator of “ serious breaches of its obligation of permanent, continuous and regular availability of mobile electronic communications services ”. This decision was notified to the operator on June 2.
The Maroc Telecom subsidiary must, within a firm period of three months, comply with its obligation of availability of services under penalty of sanction. To this end, the operator will implement the procedures, equipment, protections and redundancies necessary to guarantee the quality and availability of services under the conditions defined by the regulator.
This decision by the regulator falls within the framework of its mission to ensure compliance with the operators’ specifications. The said document specifies in its article 27.1 that the license holder must ensure the permanent, continuous and regular availability of the authorized services, as well as the permanent adaptation of the means it implements and of the services to new requirements.
Recall that in May 2021, Moov Africa Togo was already sanctioned by ARCEP for the same breaches. If the operator complies with the recommendations of the Regulatory Authority, this will guarantee permanent, continuous and regular availability of mobile electronic communications services in Togo. It will also spare consumers the many usual inconveniences and harms, in a context marked by the strong demand for digital services.
